TERMS AND CANCELLATION POLICY

Registered in the Commercial Register kept at the Municipal Court in Prague under ref. no. C 312320 (hereinafter referred to as the “provider”)
for the purposes of these terms and conditions, the client is any person who has ordered one or more services (also referred to as a “course”) from the provider via an order (application form). See Article II – subject of performance – provided services.
the provider and the client are hereinafter also referred to as the contracting parties.
ARTICLE I – INTRODUCTORY PROVISIONS
- the general terms and conditions (hereinafter also “GTC”) form an integral part of the contract concluded between the client and the relevant provider.
- a contract between the client and the provider is created upon submission of an electronic course application (hereinafter referred to as “order”) via the Lektory booking system.
- based on this application, the provider confirms acceptance by sending a confirmation email to the address provided by the client, along with payment details and other relevant documents. if the provider does not do so, the order is not considered accepted.
- the submission of an application by the client is binding and, after payment, the cancellation policy applies (see Article VII).
- the agreed terms of the contractual relationship may only be changed or cancelled by express agreement of both parties and in accordance with the terms set out in these Terms and cancellation policy.
ARTICLE II – SUBJECT OF PERFORMANCE – PROVIDED SERVICES
the subject of performance includes:
a) a regular course
b) a one-off course or other one-time event
ARTICLE III – COURSE FEE PAYMENT
the course fee may be paid:
a) online by card – in this case, payment is processed via the ComGate Payments gateway, under the terms available at: https://www.comgate.cz/smluvni-dokumenty. for card payments, the fee must be paid within 3 days.

b) by bank transfer, according to payment instructions provided with the order confirmation. for bank transfers, payment is due within 7 days unless stated otherwise. if the client applies less than 7 days before the course begins, payment must be made no later than the day before the event — the date of the outgoing payment applies. in such cases, the client must show proof of payment on the day of the event.
c) in cash on the day of the event, if this payment method is allowed for the specific event.
for payments made by bank transfer, a tax document is issued upon request. if a third party (e.g. the client’s employer) pays the course fee, the provider will issue an invoice using the provided payer details.
ARTICLE IV – CLIENT-RELATED OBSTACLES
if the course fee is not paid on time, the client will receive a reminder via email with a new deadline. if the client still does not pay, the contractual relationship is terminated. if they still wish to join, they must reapply. participation is not guaranteed and the provider is not obliged to hold a place once the extended deadline passes.
ARTICLE V – PROVIDER-RELATED OBSTACLES
the provider may specify a minimum number of participants. if this number is not reached, the provider is entitled to cancel the course, no later than after the first session. the contractual relationship then ends on the day of cancellation.
the provider may also cancel the course for other objective reasons and will inform the client without delay.
in such cases, the client is entitled to a full refund (100%). the provider may also cancel the course if:
a) participant numbers drop below the required minimum,
b) the instructor is no longer available and cannot be replaced.
in these cases, the client will receive a proportionate refund based on the number of completed sessions vs. those remaining.
ARTICLE VI – FEES
- the course fee for a specific course is listed in the reservation system.
- regular courses include 15 sessions in the winter term and 15 sessions in the spring term unless otherwise specified.
ARTICLE VII – CANCELLATION POLICY
- cancellations must be submitted in writing (email). the date of receipt determines which cancellation terms apply. the provider has the right to charge the following cancellation fees:
- cancellation fees:
● cancellation 5 days or more before the second session, or 14 days or more before the start of the spring term = cancellation fee 0%
● cancellation at any later time = cancellation fee 100% (exceptions may apply for serious medical reasons – see section 3)
● cancellation 2 days or fewer before the course = cancellation fee 100%
ARTICLE VIII – SERVICE DELIVERY AND CONDITIONS OF PARTICIPATION
- the provider agrees to deliver the service with the quality and scope described in the course materials (enrolment information, website, flyers, etc.).
- the client confirms having read and accepted these conditions before submitting their application.
- the provider may issue additional conditions (e.g. participant declaration, operational or visitor rules), which will be shared before the course begins.
- if the client violates these conditions, the provider may terminate the contract early. in such cases, the client is not entitled to any refund.
- the provider uses a staged registration system (“waves”), detailed on the website and in the reservation system (Webooker). if a client registers for a course outside their category (e.g. wrong age group or time), the provider reserves the right to cancel the registration without refund, even if already paid.
- clients register via the Webooker system and must create a personal account. by registering, the client confirms they have legal capacity. minors must be registered by their legal guardian.
- the client must inform the provider in advance by email (kurzy@airgym.cz) or phone (770 688 633) of any important details necessary for smooth course participation, including:
● relevant health conditions
● language barriers
● other specific needs
failure to provide essential information in the required format or on time may result in exclusion from the course. This is treated as a client-related obstacle, and no refund will be given.
ARTICLE IX – FINAL PROVISIONS
these terms apply to all services provided under them. any changes must be made in writing and do not affect previously agreed contractual relationships.
