PRIVACY POLICY
This privacy policy is issued in accordance with Regulation (EU) 2016/679 (General Data Protection Regulation – GDPR) by AirGym Art Company s.r.o., Novostrašnická 1414/58, 100 00 Prague, Czech Republic, contact: kurzy@airgym.cz.
The purpose of this policy is to ensure compliance with the information obligations set out in Articles 13 and 14 of the GDPR.
CATEGORIES OF PERSONAL DATA AND DATA SUBJECTS
Personal data refers to any information relating to an identified or identifiable natural person. Data subjects include course participants, workshop attendees, their legal guardians or accompanying teachers, business partners, residents, users of our facilities and newsletter subscribers (hereinafter referred to as “data subjects”).
Depending on the data subject and the nature of the relationship, we process the following categories of data:
- Identification data – name, surname, title, date of birth, permanent address; for business partners also business address and company ID (IČO).
- Contact details – address, phone number, email.
- Billing and banking data – including payment details from invoices.
- Visual and audio recordings – photos and video/audio of participants and users of our facilities.
- Health information – related to participation and ensuring safety during courses, workshops, or camps.
- Participation data – course attendance and presence at our facilities.
LEGAL GROUNDS AND PURPOSES OF DATA PROCESSING
We process personal data only when one of the following conditions is met:
- Contract performance or steps prior to entering a contract, including:
- Preparing service offers
- Communicating with the data subject
- Identifying data subjects
- Providing services
- Compliance with legal obligations, particularly:
- Tax and accounting duties
- Legitimate interests, including:
- Debt recovery and dispute resolution
- Creditworthiness assessment
- Consent given by the data subject, for:
- Recording health limitations to ensure safety
- Sending marketing and information updates
- Taking and publishing photos or video of events
Refusal to provide data needed for contractual or legal purposes may prevent us from providing services.
DATA RETENTION PERIODS
Unless otherwise stated or required by law:
- For contractual purposes: data is kept during the contract and for 3 years after it ends.
- For consent-based processing: data is kept for 5 years or until consent is withdrawn.
- For legitimate interest: data is kept for 3 years from the lawful basis.
- Data is deleted or anonymised once the processing period ends.
SCOPE AND METHOD OF PROCESSING
We only process personal data necessary for fulfilling the purpose for which it was collected, and only to the extent provided by the data subject or collected in accordance with legislation.
Processing is both manual and, to a minimal extent, automated. No decisions are made solely by automated means.
DATA SHARING
We may share data with trusted third parties providing technical, administrative, or marketing support (e.g. IT services, hosting, payment providers, accounting).
Personal data may also be disclosed to public authorities as required by law, or to consultants under confidentiality obligations.
Data is primarily processed within the EU/EEA. Exceptions may apply when using social media or online marketing services. In such cases, refer to the relevant third-party policies:
RIGHTS OF DATA SUBJECTS
You have the right to:
- Request access to your data
- Request correction or deletion of your data
- Restrict or object to processing
- Data portability (under certain conditions)
- Withdraw consent (if processing is based on consent)
- Not be subject to automated decision-making, including profiling
Note: Certain rights have exceptions. For example, we cannot delete your data if we are legally required to retain it.
